Terms of Service

1. Who we are

Doses ("we", "us") is operated by Howard Davner, a sole proprietor based in East Hanover, New Jersey, United States. You can reach us at support@doses.care.

2. What the service does

Doses sends a text message at each medication time you enter, records the reply, and sends an alert to a caregiver when no reply arrives inside a window you choose. That is the whole service. It reminds and it records.

3. What the service does not do

• It does not give medical advice, and nothing it sends is medical advice.
• It does not diagnose anything or interpret symptoms.
• It never recommends taking, skipping, doubling or changing a dose.
• It does not verify that the medications, doses or times you enter are correct. It sends back exactly what you typed.
• It does not monitor anyone. Nobody is watching the messages in real time.

Every decision about medication stays with the patient, their prescriber and their pharmacist. If something about a medication is in question, call them — not us.

4. Reminders can fail

You must not rely on Doses. Text messages get delayed, dropped, filtered or blocked by carriers. Phones lose signal, run out of battery, or sit in another room. Servers, networks and third-party services go down. A reminder may not arrive, may arrive late, or may arrive after the medication was already taken. A missed-dose alert may not reach the caregiver at all.

Anyone whose health depends on taking medication on time needs a real person responsible for it. Use this alongside that, never in place of it.

5. Who may use it

You must be at least 18 to create an account or sign someone up. If you are entering someone else's phone number, you must have their permission first, and you confirm that when you submit the form. The person receiving messages must also be 18 or older.

6. Consent, and how anyone stops

The first message any number receives from us is a request for permission. No reminders are sent unless that person replies YES, and the time they agreed is recorded. Replying STOP ends all messages immediately and permanently until they ask to restart. Replying HELP returns support information. Both always work and are always logged.

7. Your responsibilities

• Enter medications, doses and times exactly as the prescription label or pharmacy printout reads. Do not enter them from memory.
• Keep the schedule current when a prescription changes.
• Only sign up people who have agreed.
• Do not enter diagnoses, conditions, or clinical notes. There are no fields for them and we do not want them.
• Keep your account credentials to yourself.

8. Cost

The service is free during the pilot. If that changes we will tell you before you are charged anything, and you can stop at any time.

9. No warranty

The service is provided as is and as available, with no warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted or error-free operation. We do not warrant that any message will be delivered, delivered on time, or delivered to the right person.

10. Limitation of liability

To the fullest extent permitted by law, we accept no liability for:

• any dose that is missed, taken late, taken twice, or taken incorrectly;
• any reminder or alert that is not delivered, is delivered late, or is delivered to the wrong person;
• any failure, malfunction, outage, defect, error or interruption of this software, the network, the messaging carrier, or any service we depend on;
• any inaccuracy in the medications, doses or times entered by you or anyone else;
• any injury, illness, death, loss or damage arising from any of the above.

We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits or lost data, under any theory of liability, even if we were advised such damages were possible. Our total aggregate liability is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. In that case our liability is limited to the smallest amount the law permits.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your use of the service, including any claim that you signed someone up without their permission, or that the medication information you entered was wrong.

12. Ending the service

You can stop at any time by replying STOP to a message or emailing us. We may suspend or end the service for anyone at any time, including if we believe numbers are being added without consent. We will make a reasonable effort to give notice, but the service may be discontinued entirely — this is a pilot.

13. Emergencies

In an emergency, call 911 (or your local emergency number). This service is not monitored, and messages sent to it are not read in real time.

14. Changes

We may update these terms. Material changes will be posted here with a new date, and where practical we will let account holders know. Continuing to use the service after a change means you accept it.

15. Governing law

These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in New Jersey, and you and we consent to that jurisdiction.
